1. Introduction and Acceptance

Welcome to TrueMove. These Terms of Service ("Terms") constitute a legally binding agreement between you and Givioo Techcrafters LLC ("we," "us," "TrueMove," or "Company").

By creating an account, purchasing a gift, or using the TrueMove mobile application (the "Service"), you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE TRUEMOVE.

NOTICE ON DISPUTE RESOLUTION: THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 12). THIS MEANS DISPUTES WILL BE RESOLVED BY INDIVIDUAL ARBITRATION, NOT IN COURT.

2. Eligibility

To use TrueMove, you must meet the following requirements:

  1. Age: You must be at least 18 years old.
  2. Location: You must be located in the United States.
  3. Status: You have not previously been banned from our Service.
  4. Criminal History: You represent that you have never been convicted of a felony, a crime of violence, a sex crime, or any crime involving harassment or stalking. We do not conduct criminal background checks on our users, but we reserve the right to ban anyone who violates this clause.

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials. You are solely responsible for all activities that occur under your account. If you believe your account has been compromised, you must contact us immediately at support@truemove.app.

4. User Conduct and Community Rules

TrueMove is a platform for genuine connections. You agree NOT to:

  1. Use the Service for any purpose that is illegal or prohibited by these Terms.
  2. Harass, bully, stalk, intimidate, or defame any other user.
  3. Use the Service for commercial solicitation (spamming) or prostitution/human trafficking.
  4. Impersonate any person or entity or post photos that are not of you.
  5. Scrape, mine, or use automated systems (bots) to access the Service or collect user data.

We reserve the right to terminate your account immediately, without refund, if you violate these rules.

5. Gifting, Purchases, and Refunds

TrueMove facilitates the sending of physical gifts to enhance connections. By making a purchase, you agree to the following terms:

  1. Intermediary Role: TrueMove acts as an intermediary. We partner with third-party suppliers to fulfill orders. We do not manufacture the items.
  2. Payment Capture: When you send a gift request, the payment is captured immediately. If the recipient declines or the request expires, a full refund is issued.
  3. Final Sale: Gifts are non-refundable once accepted by the recipient. Because orders are processed immediately upon acceptance, we cannot offer cancellations or refunds after that point.
  4. Pricing & Taxes: All prices are in USD. Prices listed may not include sales tax. Applicable taxes, if any, will be calculated and charged at the time of the transaction or reconciliation based on the recipient's location. We reserve the right to adjust final charges to account for precise sales tax requirements.
  5. Errors: We reserve the right to correct pricing errors or cancel orders suspected of fraud.

6. User Content (Your Rights and Ours)

  1. You Own Your Content: You retain ownership of the photos and text you upload to TrueMove.
  2. License to Us: By uploading content, you grant TrueMove a worldwide, royalty-free, non-exclusive license to host, store, use, display, reproduce, and modify your content strictly for the purpose of operating, developing, and improving the Service (e.g., showing your profile to other users).
  3. Prohibited Content: You may not upload nudity, pornography, violence, or copyrighted material you do not own. We reserve the right to remove any content at our sole discretion.

7. Copyright Infringement (DMCA)

If you believe your work has been copied in a way that constitutes copyright infringement, please provide a notice containing the following to our Copyright Agent at support@truemove.app:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
  2. A description of the copyrighted work that you claim has been infringed;
  3. A description of where the material that you claim is infringing is located on the Service;
  4. Your address, telephone number, and email address;
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

8. Safety and Offline Interactions (IMPORTANT)

TrueMove is not responsible for the conduct of any user on or off the Service.

  1. No Background Checks: We do not conduct criminal background checks or identity verification on our users. You are solely responsible for your interactions with others.
  2. User Responsibility: You agree to use caution in all interactions, especially if you decide to communicate off the Service or meet in person.
  3. Release of Liability: You hereby release Givioo Techcrafters LLC and its officers, employees, and agents from any claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with your interactions with other users.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, TRUEMOVE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT YOU WILL FIND A CONNECTION, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY CONTENT SUBMITTED BY USERS IS ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GIVIOO TECHCRAFTERS LLC BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TRUEMOVE IN THE SIX (6) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Givioo Techcrafters LLC from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of a third party (including other users).

12. Dispute Resolution (Arbitration Agreement)

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR RIGHTS.

  1. Mandatory Arbitration: Any dispute arising out of or relating to these Terms or the Service shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA).
  2. Class Action Waiver: YOU AND TRUEMOVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
  3. Venue: The arbitration shall be conducted in the state of Wyoming, or at another mutually agreed location.

13. App Store Terms (Apple/Google)

The following applies if you accessed the Service through the Apple App Store or Google Play Store:

  1. These Terms are between you and TrueMove, not Apple or Google.
  2. Apple and Google have no obligation to furnish maintenance or support services for the App.
  3. You acknowledge that Apple and Google are third-party beneficiaries of these Terms and have the right to enforce them against you.
